Unfortunately, the first discrepancies between parents regarding this issue are beginning to arise.
We must distinguish by age groups:
- From 12 YEARS OLD
We must keep in mind that vaccination falls under parental authority, meaning that the parent with custody does not make the decision.
In most cases, parental authority is shared, so while the best solution is to seek consensus by considering the child's best interest, if parents are unable to reach an agreement, there is the possibility of going to court so that the judge can resolve this issue through voluntary jurisdiction.
Logically, this does not apply if one of the parents has been judicially granted exclusive parental authority.
- 16 YEARS OR OLDER
From the age of 16, minors have the legal capacity to accept or reject vaccination on their own.
This means that verbal consent from one parent would suffice if there is no clear opposition from the other.
It should also be noted that the Government has stated that “COVID-19 vaccination should be considered for these purposes as an official schedule vaccination and its indication has been established by health authorities.”
