Child Support for Adult Children Who Continue Studying: Termination and Time Limit
Regarding child support for adult children who continue studying, the Supreme Court has issued Judgment 1424/2019, dated November 6, 2019, which reminds us that if there is no evidence of negligence, passivity, or lack of concern for their studies, the limitation or termination of support is not justified.
In the cited judgment of the Supreme Court, the following considerations are made:
• No passivity has been proven on the part of either of the daughters in their studies.
• Both daughters are in the midst of their academic and professional training period, consistent with their ages.
• In these situations, “where there is no evidence of passivity in obtaining employment or completing academic training, it is not appropriate to impose strict deadlines on the children to achieve it.”
• It adds that the reasons for the delay of children in leaving home are numerous and not always attributable to their passivity.
